These Privacy Policy explains how we process the personal data of visitors to the website www.escapetojasna.sk, persons who contact us, and persons interested in accommodation at Jasná Escape Apartment.

When processing personal data, we proceed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, the General Data Protection Regulation (GDPR), and Act No. 18/2018 Coll. on the Protection of Personal Data.

2. What Personal Data We Process

We process only personal data that is adequate, relevant and necessary in relation to the specific purpose of processing.

  • data necessary to process a reservation or accommodation enquiry,

3. Purposes for Which We Process Personal Data

3.1 Processing a Contact or Reservation Form

If you contact us via a form, e-mail or telephone, we process your personal data for the purpose of handling your request, answering your question, preparing a price offer or checking accommodation availability.

The legal basis for processing is the performance of pre-contractual measures or our legitimate interest in communicating with persons who have contacted us.

We process personal data for the period necessary to handle your request, but generally for no longer than 12 months from the last communication, unless another contractual or legal relationship is established.

3.2 Reservation and Provision of Accommodation

If you book accommodation with us, we process the personal data necessary to confirm the reservation, communicate before arrival, provide the stay, handle reservation changes and related administration.

The legal basis for processing is the performance of a contract or the performance of pre-contractual measures.

We process personal data for the duration of the contractual relationship and subsequently for the period necessary to prove, exercise or defend legal claims.

3.3 Accounting and Tax Obligations

If an obligation arises to issue an accounting or tax document, we process the personal data included in these documents for the purpose of fulfilling statutory accounting and tax obligations.

The legal basis for processing is compliance with a legal obligation.

Accounting and tax documents are retained for the period stipulated by law.

3.4 Protection of Legal Claims

To the necessary extent, we may also process personal data for the purpose of protecting our rights, handling complaints, claims, disputes or proving legal claims.

The legal basis for processing is the controller’s legitimate interest in protecting its rights and legally protected interests.

We retain data for this purpose for the duration of the applicable limitation periods or for the duration of related proceedings.

  • reservation system provider, if used,

We do not provide personal data to third parties for their own marketing purposes.

6. Transfer of Personal Data Outside the European Union

We strive to process personal data primarily within the European Union or the European Economic Area.

If the use of certain services, such as analytical, map, reservation or communication tools, involves the transfer of personal data to third countries outside the European Union or the European Economic Area, such transfer will take place only in accordance with GDPR requirements, in particular on the basis of appropriate safeguards, an adequacy decision or another lawful mechanism.

7. How Long We Retain Personal Data

We retain personal data only for the period necessary to fulfil the purpose for which it was obtained or for the period required by legal regulations.

10. Your Rights as a Data Subject

As a data subject, you have the following rights under GDPR:

  • right of access to personal data – you have the right to obtain confirmation as to whether we process your personal data and to access such data,
  • right to rectification – you have the right to have inaccurate or incomplete personal data corrected,
  • right to erasure – you have the right to request the deletion of personal data if the statutory conditions are met,
  • right to restriction of processing – you have the right to request that we restrict the processing of your data in certain cases,
  • right to object – you have the right to object to the processing of personal data based on legitimate interest,
  • right to data portability – if the processing is based on consent or a contract and is carried out by automated means,
  • right to withdraw consent – if processing is based on consent, you may withdraw it at any time,
  • right to file a motion to initiate proceedings or a complaint with the supervisory authority.

The Office for Personal Data Protection of the Slovak Republic lists, among the rights of data subjects, for example the right of access, rectification, erasure, restriction of processing and other rights under GDPR.

13. Security of Personal Data

We adopt appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access, disclosure, alteration or destruction.

These measures may include, in particular, securing the website with HTTPS, restricting access to personal data, regularly updating technical solutions, protecting forms against misuse and appropriate backups.

We may update these Policy from time to time, in particular in the event of changes to legal regulations, the technical solution of the website or the method of personal data processing.
